Non-Conforming Work In the event that the contractor fails to conform to the contract documents, the Resident Engineer must notify the contractor in writing of nonconforming work and seek corrective action. The Engineer must inform also the owner and the design professional. After receiving comments from the design professional, the Engineer should determine if the work in question can be achieved by removal or rework, or by owner acceptance, subject to credit. The Engineer will not recommend payments for non-conforming works. The Engineer should make sure that the corrective actions have been performed by the contractor through the conduct of a joint inspection. f. Testing and Inspection For the duration of the Project, the Materials Engineer shall be entitled to witness all testing and inspection to be performed in accordance to the Quality Assurance Plan. g. Certificate of Completion If the works have been completed in accordance with the contract, have passed all tests on completion and can be taken over by the owner, then the contractor can notify the Engineer for an issuance of the Taking over certificate or Certificate of Completion. However, if in the opinion of the Engineer that there are still works to be done, the contractor shall then complete the said works before issuing another notice to the Engineer. 3.3.
